LEAKY HOMES

The leaky homes crisis has been one of the most damaging and costly events in New Zealand history. People affected by a leaky home are often in distress, and need assurance, as well as expert legal assistance.

There are issues of timing. Claims need to be brought within 10 years - which means within 10 years of the completion of the original work or Code Compliance Certificate.

Under the Building Act 2004 there was a change in the way the time period was calculated where defects were not obvious. If you are in a situation where you are considering a claim, or are involved in any way as a builder or developer, then it is critical that you get legal advice promptly.

Expert evidence can be crucial – often there may be several contributing or competing causes.

How to fix problems and associated issues of cost can be a source of dispute as well (for example patching, rebuilding or recladding).
